Abstract

ABSTRACT:
This study examines the governance of the Moroccan judicial system in a context characterized by ongoing institutional and digital transformations. It jointly draws on agency theory and Mintzberg’s organizational framework to examine relationships among institutional actors and the coordination mechanisms that shape the functioning of courts. Based on a qualitative, documentary, and conceptual approach, the analysis relies on both academic literature and Moroccan institutional sources. The findings reveal an organizational configuration close to professional bureaucracy, characterized by a high degree of professional autonomy that coexists with mechanisms of coordination, accountability, and institutional control. They also show that digital transformation contributes to improving information flows and governance capacities while introducing new forms of standardization. Combining the two theoretical frameworks reveals that the modernization of judicial governance depends on achieving a balance between professional autonomy, organizational coordination, information flows, and institutional control. Finally, the study emphasizes the need to preserve judicial independence while supporting the development of governance mechanisms and digital transformation.
Keywords: Judicial governance; Agency theory; Professional bureaucracy; Mintzberg; Digital transformation; Moroccan judicial system.
